We cannot bill the shipping charges to your own Fed-Ex, UPS, Airborne, etc., account. Corporate Policies covering the rural area we are located in do not allow for 3rd party billing of shipping charges.

ORDER CONFIRMATION

Due to the e-Mail Filtering Programs used by most ISP's (Internet Service Providers) including AOL, MSN, Earthlink and others, after placing your order you may not receive your Order Confirmation at the e-mail address you have provided. As we have NO control over this we strongly recommend that either prior to or immediately afterwards, that you contact your ISP directly and request that the domains of kimmelgnomes.com and yahoo.com specifically not be blocked.

Most online customers are e-mailed an order confirmation. If you do NOT receive this it is most likely due to arbitrary interference from your ISP, and not the fault of Kimmel Gnomes. If you do NOT receive that e-mail, YOU must contact THEM to have the block removed, as Kimmel Gnomes has NO jurisdiction over this. IN ADDITION, IF YOU HAVE AN ANTI-SPAM E-MAIL PROGRAM INSTALLED IN YOUR COMPUTER, BE SURE TO CHECK YOUR E-MAIL DELETED FOLDER FOR YOUR ORDER CONFIRMATION!

SHIPMENT METHODS

Our ONLY offered shipping methods for the United States are by UPS-Ground for the Lower-48 States. This policy allows shipping costs to be affordable for everyone.

SHIPPING TO MULTIPLE ADDRESSES

For Our Customers Shipping To Multiple Addresses: This feature within the Shopping Cart gives you the ability to send items to more than one address. Here's how it works:

• When you click on "Send to more than one address" checkboxes will appear next to each item in your shopping cart.

• Choose the item (or items), select the quantity you want to send to Address #1, and proceed with the checkout process.

• At the end of the checkout process click on "Ship to Address #2."

• You will be returned to this same shopping cart with the same selection of items to repeat the process with your next address.

• A running total will be displayed so you can keep track how much you are spending.

For your convenience and security, only your billing address is saved -- all you need to enter is the shipping address for each recipient and your credit card number.

RUSH ORDERS

Effective 08/08/2005: Due to the hand-crafted and labor intensive nature of our products, we can NO longer accept requests for Overnight Air, Next-Day Air, etc. delivery, NOR can 'Shipment Deadlines' ("must have by a certain date.....") be accepted. Please do NOT ask - such requests will have to now be refused.

ORDER PROCESSING

Most of our orders usually ship within 7 to 14 business days after being placed. We require this time to actually physically make the gnomes by hand (one by one), as we do NOT import and sell the ready-made plastic gnomes that are found elsewhere.

DELIVERY TIMES

Shipments are sent by the most expedient and efficient means possible, with an expected Estimated Time of Arrival of 3 to 7 business days (for Lower 48 States) from the date of shipment (Note: Please make sure the shipping address you submit IS correct - Incorrect addresses will delay receipt of your order).

Please allow for additional time during Holiday periods. Please also note: "Business Days" refers to Weekdays, Monday through Friday - Weekends (Saturday & Sunday) and Holidays are NOT business days.

SHIPMENTS TO ALASKA. HAWAII, PO BOXES, U.S. TERRITORIES, MILITARY ADDRESSES, CANADA, AND ALL OTHER FOREIGN COUNTIRES

We ship ONLY to the LOWER 48 United States of America. Sorry, we CANNOT accept ANY orders to Hawaii, Alaska, P.O. Boxes, APO/FPO AE-AP-AA Military Addresses, nor to U.S. Territories located outside the Continental United States. We do NOT ship the Canada nor any other Foreign Destinations, NO exceptions.

SHIPMENTS TO SCHOOLS AND UNIVERSITIES

To Those Shipping to Schools, Colleges & Universities: Simply entering the institution's name and department unfortunately is insufficient - UPS and USPS will NOT deliver unless we have an exact street address and room / suite number. Most institutions have a standardized mailing address to receive shipments - if you need to ship to your place of learning please use that address.

SHIPPING ADDRESSES

Shipping Addresses MUST be correct and complete! UPS charges us a Service Charge for every incomplete and incorrect address they receive. This fee will in turn be passed along to the customer! Floor / Apartment / Suite (etc.) numbers MUST be included with the Shipping Address! WE cannot ship to P.O. Boxes

Effective 11/25/2011: Shipping Charge Notes: Due to the added weight and extra-large size of Item #R77AP 'Stanley', Item #R13-AP 'Merryweather', Item #R45-AP 'Crocus' or Item #R28-AP 'Herbert', an additional charge of $40.00 per Gnome will be added to the above rates for every 'Stanley', 'Merryweather', 'Herbert' or 'Crocus' ordered.

SHIPPING COSTS

Our shipping rates are actually below what the average shipment costs us to send. As our Gnomes are NOT made in China for Pennies on the Dollar, we cannot absorb the full shipping costs ourselves which also include the expenses of Boxes, Bubble Wrap, and Void Fill (in addition to having these materials shipped HERE at considerable cost), just to name a tiny few.

ADDRESS CORRECTIONS

Please make certain your shipping address is absolutely correct before placing your order. Your order will be shipped from Kimmel Gnomes to the address as the customer has written. However this is no guarantee the shipping address is correct! UPS charges us a FEE for every incorrect address received - this fee will be in turn passed along to the customer! Packages returned or lost due to incorrect shipping addresses will be the liability of the customer.

GIFT SHOPPERS

NOTICE TO 'LAST MINUTE SHOPPERS': Our ONLY shipping method is by UPS Ground (Lower 48 States), which has been on average arriving within 3 to 7 business days after being shipped, with additional time expected during holiday periods. We do NOT offer an alternative shipping method due to the HIGH costs involved. UPS Overnight runs an additional $100-$150 or more, or UPS 2nd Day an additional $75-$100 or more! We strongly advise shopping ahead of time for that upcoming birthday, anniversary, or holiday gift!

SECURITY

"MAIL ORDER FRAUD IS A FELONY". Your ISP address is recorded. Unauthorized "fraudulent" credit card charges are immediately forwarded to the proper authorities.

EXCHANGES

If you purchased or received our gnomes as a gift, they may be returned postage-paid & insured for exchange, ONLY if done so within 30 days of receipt, and the gnome is undamaged. Return postage is NON-refundable and payment for shipping charges for the exchanged gnome MUST be included with the gnome you are returning. Failure to include the exchanged gnome shipping charges WILL delay the exchange!

RETURNS

Your satisfaction as a Kimmel Gnomes customer is of paramount importance to us! Returns: We offer a 30 Day Money Back Guarantee on all our Gnomes (original shipping charges / return postage non-refundable) if not completely delighted with your purchase. Merchandise must be returned in the same condition as it was received. Products MUST be returned within 30 days of receipt. NO returns will be accepted without prior authorization! All returns MUST include a copy of your invoice and explanation as to why it is being returned. Any returns not meeting the aforementioned criteria will be returned to the sender at the sender's expense!

DAMAGE CLAIMS

If your merchandise is received damaged, you must contact our Customer Service department immediately. Please retain all damaged items and wait to receive further instructions from us. ALL Damage Claims MUST be made within 24 Hours of Receipt, NO exceptions.

SPECIFIC DELIVERY TIMES
Our Gnomes are made to order, meaning that as we receive your order each piece is hand crafted, hand decorated and then fired in our kiln. This process normally takes two to three weeks plus shipping. As we get closer to the holiday season you will be looking at a 3 to 5 week turn around time.
