CLAY Gnomes One-Year Guarantee Against Frost Damage.
Kimmel Gnomes CLAY Gnomes are guaranteed against frost damage for one year from date of purchase. If during the course of your first year of ownership your clay gnome suffers damage due to frost, your gnome may be returned to Kimmel Gnomes for replacement. NOTE: The following information below pertains to our CLAY Gnomes ONLY. For information on Resin, Terracotta, and Mushroom Spikes products please scroll down to 2nd section.
NOTE: ONE-YEAR GUARANTEE DOES NOT APPLY TO TERRACOTTA, RESIN OR MUSHROOM SPIKES PRODUCTS!
Before returning your gnome, please note the following:
(1) Before returning your clay gnome, you must first contact Customer Service for authorization. Gnomes returned without prior authorization will be refused and returned at the customer's expense. Authorizations will only be issued by e-mail. fax, or mail - no authorizations can be granted over the phone.
(2) Return shipping & insurance costs are the responsibility of the customer - we do not reimburse on return shipping costs.
(3) A copy of your original invoice, e-mail order confirmation or some form of proof of purchase besides the merchandise must be enclosed with your return. Returns received without documentation will be refused and returned at the customer's expense. A letter of explanation as to why the product is being retuned must be enclosed.
(4) No refunds nor credits will be issued - limits of liability are strictly limited to the replacement of the product with the same article.
(5) Absolutely NO REPLACEMENTS AFTER ONE YEAR of purchase date will be issued - NO exceptions.
(6) The 'One-Year Guarantee Against Frost Damage' is strictly limited to damage to the product caused by frost. Damaged products returned for replacement due to any and all other causes will be promptly refused and will be returned at the customer's expense.
(7) Our 1 Year Guarantee does NOT cover any Mushroom Spikes, Terracotta or Resin Products.

We guarantee our clay gnomes for only one year because it has been our experience that people expect us to replace a gnome that they have run over with their car, or their kids have used as target practice, etc.. We use extremely frost resistant stoneware pottery which is made to be placed outside all year round. But it is pottery and therefore pottery gets broken in a variety of ways. We are restricting our guarantee so that in 50 years we are not liable for a gnome that was run over with the lawnmower! Our gnomes are extremely hardy but like anything else, they are not bomb-proof but as close as we can come given the medium (clay) in which we work. Regarding ALL Resin, Terracotta, or Mushroom Spikes Products: All resin products are sold without any warranty expressed or implied. We cannot and will not guarantee these products against damage from the elements or from anything else, and the LOW purchase prices reflect this. If you require a warranty with your purchase then you will need to purchase from our line of other CLAY Gnomes and products. Thank you. THE FOLLOWING INFORMATION IS ONLY APPLICABLE TO PAINTED CLAY PRODUCTS PRODUCED PRIOR TO AUGUST 2004 AND DOES NOT APPLY TO ANY CURRENT (GLAZED) CLAY PRODUCTS.
DISCONTINUED PAINTED PRODUCTS All painted finishes have been discontinued as of August 2004. Maintain your painted clay gnome with a coat of varnish each year or replace with a glazed, no maintenance gnome.
UPDATED FINISHES Our finishes effective August 2004: We color our clay gnomes with a matt glaze and only use acrylic paint for small details on some gnomes. The glaze finish ensures true color and zero maintenance for the life of the gnome. |
